TITLE

Recommendation to authorize Development Services Department to process a refund in the amount of $12,565 to JPI Real Estate Acquisitions, for a project at 333 West Ocean Boulevard.  (District 2)

DISCUSSION

On January 14, 2020, JPI Real Estate Acquisitions paid fees to the Development Services Fund Group for plan check services and surcharges related to the preparation of a permit application to demolish the old City Hall building. However, this developer is not moving forward with this project and the applicant is eligible for a refund of $12,565.

In accordance with Long Beach Municipal Code Section 3.48.040, refunds exceeding $10,000 must be approved by the City Attorney and City Council. Authorization to process the refund is requested on behalf of the applicant.

This matter was reviewed by Assistant City Attorney Michael J. Mais on October 12, 2020 and by Budget Analysis Officer Julissa José-Murray on October 15, 2020.

TIMING CONSIDERATIONS

City Council action is requested on November 17, 2020, to expedite processing of the refund.

The approval of this recommendation will result in a refund of fees totaling $12,565 from the Development Services Fund Group in the Development Services Department. This recommendation has n ot staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities.
