TITLE
Recommendation to adopt resolution authorizing City Manager to execute a contract with Gen-Probe Sales and Service, Inc., to purchase diagnostic test kits for one year for the estimated sum of $150,000, with the option to extend the contract for two additional years at the discretion of City Manager. (Citywide)

DISCUSSION
The City's Department of Health and Human Services (DHHS) Public Health Laboratory performs approximately 15,200 Chlamydia tests, 12,000 Gonorrhea tests and 260 DNA mycobacteria identification tests each year. The DHHS conducts tests as a requirement for the operation of the Sexually Transmitted Disease (STD) Clinic, a core responsibility of which is to treat and prevent STD and communicable diseases. Gen-Probe is the only
company that produces a molecular DNA probe test for the identification of mycobacteria. Because the technology used by Gen-Probe for the Chlamydia and Gonorrhea testing methodology is proprietary and not available from any other manufacturer, the attached Resolution is necessary to authorize the City Manager to execute a contract without advertising for bids. This matter was reviewed by Senior Deputy City Attorney Donna Gwinn on August 22,2005 and Budget Management Officer David Wodynski on August 26,2005.

TIMING CONSIDERATIONS
City Council action on this matter is requested on September 6,2005 to maintain inventory of these diagnostic testing kits.


FISCAL IMPACT
Purchases not to exceed $150,000 per year are offset by the revenue produced by programs and outside agencies requesting the tests. Sufficient funds are budgeted in the Health Fund (SR130) in the Department of Health and Human Services (HE).
