Recommendation to authorize City Attorney to pay the sum of $40,000 in full settlement of lawsuit entitled Julie Gates et al. v. City of Long Beach.
 
DISCUSSION
Plaintiffs allege that on May 9, 2003, they sustained property damage caused by the City of Long Beach Water Department, when water department employees performed repair work on a sewer main.  The sewage caused extensive damage to the Gates' personal property and to an office-basement built below grade.  Plaintiffs claim out-of-pocket expenses and lost earnings.
 
After negotiations with plaintiffs' counsel, the plaintiffs have agreed to settle the matter for the sum of $40,000 as to the City of Long Beach.
 
The proposed settlement was presented to the Economic Development and Finance Committee on March 5, 2005, and was approved on that date.
