TITLE
Recommendation to authorize City Manager to execute a repair agreement with the City of Long Beach and Olson 737-Long Beach 2, LLC, for a sinkhole on the mid-block of the Promenade.  (District 2)
 
DISCUSSION
In 2008, Olson 737-Long Beach 2, LLC, (Olson) completed a mixed-use condominium project with subterranean parking, commonly known as 133 Promenade Walk (Project), on the mid-block of the Promenade between 1st Street and Broadway.
 
In February 2010, a sinkhole appeared on the Promenade adjacent to the Project within the public right-of-way (Exhibit A). It has been determined that the sinkhole was a result of the lack of soil compaction during the construction of the Project. Therefore, Olson has agreed to enter into a Repair Agreement with the City of Long Beach and absorb the $12,091 expense associated with the repair of the sinkhole damage.
 
The repair will include waterproofing the lower level garage walls of the Project, compaction of the soils associated with the sinkhole, removal and replacement of the sidewalk, and replacement of landscaping along the damaged area of the Promenade.
 
This letter was reviewed by Chief Assistant City Attorney Heather Mahood on May 16, 2011, and by Budget Management Officer Victoria Bell on May 19, 2011.
 
TIMING CONSIDERATIONS
City Council action is requested on June 7, 2011, to expedite implementation of the proposed Agreement.
 
FISCAL IMPACT
There is no impact to the General Fund and no local job impact as a result of this recommended action.
 
SUGGESTED ACTION
Approve recommendation.
