Increase appropriations in the Marina Fund (TF 403) in the Department of Parks, Recreation and Marine (PRM), by $1,839,815 for construction and construction support costs related to this Project.  (District 2)
 
DISCUSSION
The City of Long Beach owns and operates three full-service marinas, including the Alamitos Bay Marina (Alamitos Bay), Long Beach Shoreline Marina (Shoreline Marina), and Rainbow Harbor/Rainbow Marina (Rainbow Marina), which are operated by the Parks, Recreation and Marine Department (PRM). To service these marinas, the City maintains two fueling docks, one in the Shoreline Marina and one in Alamitos Bay.
 
In September 2008, the Shoreline Marina fuel dock was closed as it did not meet current regulations. As a result, only the Alamitos Bay location is available for fueling needs. Recently, staff has been proceeding with the objective to remove and replace the UST and restore this facility to full operation. On August 3, 2010, City Council approved Contract No. 31822 with EFS West (Contractor) for Phase I of this project, which funded the removal of the existing non-compliant UST. Through this Council action, staff seeks to proceed with the replacement of the UST. Once these improvements are completed, the facility will be re-opened.
 
The contractor has completed the removal of the UST and has complied with all other environmental requirements related to UST removals in order to comply with the City's obligations and State regulations. The contractor is currently finalizing the remaining Phase I task of developing the plans for the replacement of the UST.
 
Staff is now requesting authorization to move forward with the Phase II portion of the contract, which will include the installation of a new UST, and the physical construction of the new fuel site and necessary dock structures.
 
This matter was reviewed by Deputy City Attorney Linda Trang on April 29, 2011 and by Budget Management Officer Victoria Bell on April 28, 2011.
 
SUSTAINABILITY
Keeping the Long Beach coastal assets and the public safe from the environmental hazards of operating fuel sites is of vital importance to the City. The City's adopted Underground Storage Tank Compliance Program has been designed to prevent harm to the environment from the City's fuel sites and underground storage tanks. With the availability of a local fueling site, less fuel will be utilized and fewer pollutants will be generated by the local boaters into the local environment.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on May 17, 2011 to authorize commencement of Phase II of this project. Phase II is estimated to be completed within four months after all related permits are acquired. In order to meet certain regulatory requirements, it is critical to complete this project by February 2012.
 
FISCAL IMPACT
The Phase II portion of the contract is estimated at $1,606,407. In addition, the project will incur costs for construction inspection, lab testing, and regulatory permit fees for a total estimated cost for Phase II to $1,839,815. Since these funds are not currently budgeted, an appropriation increase of $1,839,815 is requested in the Marina Fund (TF403) in the Department of Parks, Recreation and Marine (PR). During the course of construction, up to 22 people will be employed by this contract.
