TITLE
Recommendation to authorize Department of Development Services to process a refund in the amount of $33,989 to Interior Architects for the property located at 3880 Kilroy Airport Way. (District 5)
DISCUSSION
On December 14, 2010, Interior Architects paid building permit fees and surcharges totaling $41,568 to make tenant improvements to property located at 3880 Kilroy Airport Way. The owner canceled the project; therefore, the applicant is eligible for a refund (Long Beach Municipal Code Section 21.21.701) in the amount of $33,989.
In accordance with Long Beach Municipal Code, Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, an approval to process the refund is requested on behalf of the applicant.
This matter was reviewed by Assistant City Attorney Michael J. Mais on March 9, 2011 and by Budget Management Officer Victoria Bell on March 16, 2011.
TIMING CONSIDERATIONS
City Council action is requested on April 5, 2011 to expedite processing of the refund.
FISCAL IMPACT
The amount of $23,925 will be refunded from the Development Services Fund (SR 137), and $10,064 will be refunded from the General Fund (GP). No known job impacts will result from this action.
SUGGESTED ACTION
Approve recommendation.
