TITLE
Recommendation to authorize City Manager to execute a Memorandum of Understanding, any subsequent amendments thereto, and all necessary documents with the Long Beach Job Corps Center (LBJCC) to provide local law enforcement authority to enforce laws and conduct investigations on LBJCC premises, which are under Federal jurisdiction. (District 7)

DISCUSSION
On February 17, 1998, LBJCC began operations at 1903 Santa Fe Avenue. LBJCC provides career technical training and education programs for students ages 16 through 24. The campus is on Federal property and under Federal jurisdiction. A Memorandum of Understanding (MOU) between the Long Beach Job Corps Center (LBJCC) and City of Long Beach, entered into in 2007, provides local law enforcement authority to enforce laws and conduct investigations on the campus. LBJCC has a Zero Tolerance Policy for violence, alcohol, and drugs.

LBJCC has requested that the City of Long Beach enter into a new MOU that will formalize the addition of inter-agency guidelines for LBPD & LBJCC with regard to the enforcement of state and local laws on Federal property. Additionally, the new MOU will allow for subsequent amendment with the consent of all parties and subject to the approval of the City Manager. Once signed the new MOU will be in effect indefinitely, subject to periodic review and amendment by both signatory entities. Either party wishing to terminate the agreement must submit written notice to the other party 30 days prior to the intended termination date.

This letter was reviewed by Deputy City Attorney Gary Anderson on January 20, 2011 and Budget Management Officer Victoria Bell on January 11, 2011.

TIMING CONSIDERATIONS
City Council action on this matter is requested on February 1, 2011, to expedite the agreement.

FISCAL IMPACT
