DISCUSSION
City Council authorized the City Manager to execute a Cooperative Agreement with the Orange County Transportation Authority (OCTA) on November 3, 2009. The Cooperative Agreement provides for OCTA funds for construction of certain traffic mitigation measures in East Long Beach related to the OCTA’s West County Connectors project.

Among the project improvements is reconstruction of the northbound I-405 to westbound 7th Street connector. The connector currently carries approximately 30,000 vehicles per day and will be closed for a period of one year. Traffic will be diverted from the connector to Studebaker Road, Atherton, Bellflower, Spring and Palo Verde Streets during construction of the project.

The Cooperative Agreement was executed September 13, 2010 and provides the City of Long Beach a total of $1,150,000 to construct certain traffic mitigation measures as identified in the attachment. Per the Agreement, $600,000 of this total is to be remitted upon receipt by OCTA of an invoice from the City; $300,000 is to be paid to the City upon request and when the first $600,000 has been spent; and $250,000 is to be paid to the City upon completion of the connector project by OCTA.

This matter was reviewed by Deputy City Attorney Linda Trang on October 18, 2010, and by Budget Management Officer Victoria Bell on October 22, 2010.

TIMING CONSIDERATIONS
OCTA has been invoiced for the initial $600,000 and the payment is expected to be received by the City by November 9, 2010. The City is required to construct the improvements within 55 calendar days of OCTA awarding a construction contract, which occurred October 12, 2010.
