DISCUSSION
On September 27, 2010, Meta Housing/Long Beach & Burnett LP paid development impact fees totaling $251,447 for their property located at 2355 Long Beach Boulevard. When the development impact fees were assessed, the exact unit count for affordable units was unknown. Any unit that qualifies as deed restricted for occupancy by a low-income household is eligible for an exemption from development improvement fees. In accordance with Long Beach Municipal Code, Sections 18.17.130.B.2, 18.18,120.B, 18.23.110A.5, and 18.22.110.A.5, 24 housing units at the development are eligible; therefore, Meta Housing is entitled to a refund (Long Beach Municipal Code Section 18.12.240) in the amount of $131,190.

In accordance with Long Beach Municipal Code, Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, an approval to process the refund is requested on behalf of the applicant.

This matter was reviewed by Deputy City Attorney Gary J. Anderson on October 11, 2010 and by Budget Management Officer Victoria Bell on ­­­­­­­­­­­­October 18, 2010.

TIMING CONSIDERATIONS
City Council action is requested on November 9, 2010 to expedite processing of the refund.

FISCAL IMPACT
The development impact fees consist of five fees totaling $131,190 and will be refunded from the following funds:

· Transportation Improvement (CP 201) $ 26,460
· Park Development (SR 180) $ 80,585
· Police Facilities Development (SR 180) $ 12,759
· Fire Facilities Development (SR 180) $ 8,981
· Administrative Fee (SR 137) $ 2,405
$131,190

There is no local job impact as a result of this recommendation.
