Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at Creama located at 440 Pine Avenue.  (District 1)
 
DISCUSSION
The operator of the Creama restaruant, located at 440 Pine Avenue, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining.  The proposed permit areas and a list of furnishings and accessories to be placed in the permit areas are shown on the attachment. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way.  The width of the sidewalk at this location varies between 12 and 22 feet wide. A minimum clearance of 5 feet is to be maintained along the central sidewalk path between the permit areas.
 
Assistant City Attorney Michael J. Mais reviewed this matter and prepared the subject permit on August 13, 2010. Budget Management Officer Victoria Bell reviewed this matter on August 13, 2010.  The Long Beach Fire Department's review and approval of this request will be obtained prior to permit issuance.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A permit processing fee of $546 was deposited into the General Fund (GP) in the Department of Public Works (PW).  Approval of this permit may have a positive impact on local jobs.

Approve recommendation.
