TITLE
Recommendation to authorize Department of Development Services to process a refund in the amount of $50,592 to Pacific Castle Long Beach LP for the property located at 6511 Pacific Coast Highway. (District 3)
DISCUSSION
On March 26, 2010, Pacific Castle Long Beach LP paid planning permit fees and surcharges totaling $59,520 to develop the property located at 6511 Pacific Coast Highway. The applicant has withdrawn from the development project and is eligible for a refund (Long Beach Municipal Code Section 21.21.701) in the amount of $50,592.
In accordance with Long Beach Municipal Code, Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, an approval to process the refund is requested on behalf of the applicant.
This matter was reviewed by Assistant City Attorney Michael J. Mais on July 28, 2010 and by Budget Management Officer Victoria Bell on August 3, 2010.
TIMING CONSIDERATIONS
City Council action is requested on August 24, 2010 to expedite processing of the refund.
FISCAL IMPACT
The amount of $50,592 will be refunded from the Development Services Fund (SR 137). No job impacts will result from this action.

Approve recommendation.
