TITLE

Decrease appropriations by $116,630 in the Tidelands Operating Fund (TF 401) in the Department of Public Works (PW), and increase appropriations by $116,630 in the Tidelands Operating Fund (TF 401) in the Department of Parks, Recreation and Marine (PR); and

DISCUSSION
City Council approval is requested to enter into a contract with Dutra Dredging Company for dredging the entrance to the Rainbow Harbor (Entrance).  The U.S. Army Corps of Engineers (ACE) is in the final planning stages of a project to dredge approximately 185,000 cubic yards of material from the Federal Channel in the Los Angeles River Estuary.  The Entrance is not part of the Federal Channel, and is outside of the area maintained by the ACE.  This area has shoaled to the point that tall ships entering and exiting Rainbow Harbor are finding it difficult to operate, and have occasionally run aground.  Rainbow Harbor is homeport to two tall ships, and is host to at least two public tall ship events per year.  An engineering analysis has determined that approximately 27,000 cubic yards of silt must be dredged to create a depth of 15-feet at the entrance to Rainbow Harbor.
 
In 2007, the ACE bid the Federal Channel dredging project and received two bids.  Dutra was the lowest responsible bidder and was awarded the contract.  In an effort to reduce the City's cost for dredging the entrance to Rainbow Harbor, the Department of Parks, Recreation and Marine approached Dutra and ACE requesting the inclusion of the Entrance to their Federal Channel dredging project.  Dutra has agreed to extend the terms of their contract with ACE to the City.   This will result in a savings of $500,000, should a new, separate contract be required. The total cost of the dredging the Entrance, including permits and construction, is estimated at $585,000.
 
On June 15, 2010, the City Council authorized a Memorandum of Understanding (MOU) between the City of Long Beach and the Harbor Department, to allow ACE to place dredged material from the portion of the Los Angeles River Estuary under their jurisdiction into Slip 1 in the Middle Harbor.  In order to facilitate this project, the MOU must be amended to allow the City to place dredged material taken from the entrance to Rainbow Harbor into Slip 1 in the Middle Harbor.
 
This matter was reviewed by Deputy City Attorney Gary Anderson on July 13, 2010, and by Budget Management Officer Victoria Bell on July 12, 2010.  
 
SUSTAINABILITY
 
The contract will fund a project that will remove contaminated sediment from the mouth of Rainbow Harbor, which will result in a cleaner waterfront and improved recreational and commercial access.  
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on August 3, 2010, to enable the City to take advantage of the ACE contract with Dutra.  ACE is scheduled to begin working on its portion of the project in late July 2010.
 
FISCAL IMPACT
The contract award is for an estimated amount of $539,715.  An additional amount of $45,285 is also requested for project support costs and is not part of the contract award.  
The total estimated cost of the project is $585,000, and will be funded by existing savings from other completed capital projects in the Parks, Recreation and Marine and Public Works Departments.  An appropriation adjustment is included in the recommended action to shift savings of $116,630 from completed projects in the Tidelands Operating Fund (TF 401) in Public Works (PW) to support the dredging project in Parks, Recreation and Marine (PR).  There is no local job impact associated with this recommendation.
