TITLE
Recommendation to receive supporting documentation into the record, conclude the hearing, find that the area to be vacated is not needed for present or prospective public use, and adopt resolution ordering the vacation of a portion of the alley east of Temple Avenue and north of Fourteenth Street.  (District 4)

DISCUSSION
The Redevelopment Agency (RDA) of the City of Long Beach is seeking to expand Orizaba Park into the area southwest of the old Pacific Electric rail right-of-way, and requests the vacation of the alley as shown on the attached Exhibit A. RDA own all of the parcels adjacent to the alley to be vacated except for the single family home at 1446 Temple Avenue; therefore, most of the vacated alley will become a part of the park. As indicated on attached Exhibit B, the portion of the alley adjacent to 1446 Temple Avenue will become a part of that lot, consistent with California land reversion practices.

On June 1, 2010, the City Council adopted Resolution No. RES-1 0-0057, declaring its intention to vacate the subject right-of-way, and set July 6, 2010, as the date for the public hearing.

This matter was reviewed by Deputy City Attorney Linda Trang and by Budget Management Officer Victoria Bell on June 10, 2010.

TIMING CONSIDERATIONS
The date of this public hearing was set by City Council action on July 1, 2010.

FISCAL IMPACT
The estimated cost of $3,000 will paid by the Redevelopment Agency (RDA). There is no local job impact to the City.

SUGGESTED ACTION
