TITLE

DISCUSSION
As part of the American Recovery and Reinvestment Act of 2009 (ARRA), certain funds were set aside for the rehabilitation of roads. Projects to be done under this program had to be ready to go to construction immediately, listed as a federal aide urban route (FAU) by the Federal Highway Administration, and listed in the State's Transportation Improvement Program. Wardlow Road between Clark Avenue and Palo Verde Avenue fell within this category and was approved for funding under this ARRA program.

The project was advertised in accordance with direction from Caltrans; however, a post bid opening review by the Federal Highway Administration (FHWA) concluded that due to the way a bid addendum was issued on the project during the bidding process, a major portion of the project (over $500k) would be ineligible for ARRA reimbursement. FHWA has indicated that the only way to correct this is to readvertise the project for bids. Staff will be rejecting all the current bids and readvertising the project as directed by FHWA and is requesting that this agenda item be received and filed.

This matter was reviewed by Deputy City Attorney Linda Trang on April 29, 2010, and Budget Management Officer Victoria Bell on April 29, 2010.

TIMING CONSIDERATIONS
City Council action on this matter is requested on May 4th, 2010, to allow the project to be re-advertised for bids as requested by FHWA.
