TITLE
Recommendation to adopt resolution authorizing a waiver of permit fees and other applicable fees for work in connection with recent flooding to properties in Long Beach. (Citywide)

DISCUSSION
On February 9, 2010, the City Council approved an item related to flooding from recent storms in Long Beach. Several action steps were approved, including one pertaining to waiving applicable fees, as called out in the attached resolution, for repairs to damage of properties caused by the recent storms. Under the City's current fee resolution, the City Manager is not authorized to waive permit fees; the attached resolution grants that authority.

With Council approval, all City permit fees and other applicable fees associated with work necessary to repair, correct, or replace flood or storm damaged properties located in Long Beach will be waived. This waiver will be retroactive to cover necessary permits resulting from flooding from January 19 through February 10, 2010. Additionally, staff will provide expedited building plan reviews. If State or Federal emergency assistance programs become available, staff will work with affected property owners to assist in the process.

This letter was reviewed by Assistant City Attorney Michael J. Mais on February 12, 2010 and by Budget Management Officer Victoria Bell on February 11, 2010.

TIMING CONSIDERATIONS
Immediate Council action is requested to implement the recommendation, and allow property owners ample time to apply for necessary permits before the June 1, 2010 deadline.

FISCAL IMPACT
Based on reports received from property owners for property damage caused by the January 19 through February 10, 2010 storms, it is anticipated approximately 100 properties may require City permits for repair work. The permit value is estimated to be $75,000, which represents approximately 1.1 percent ofthe permit revenue collected in the previous fiscal year (FY 2009).
