TITLE

Recommendation to authorize City Manager, or designee, to execute the First Amendment to Lease Agreement No. 28338 between City of Long Beach (City) and the County Sanitation District No. 3 of Los Angeles County (County) for the property located at 1173 North Loma Vista Drive.  (District 1)

 

DISCUSSION

On September 10, 2002, the City Council authorized the City Manager to enter into a 20-year lease agreement with County Sanitation District No. 3 of Los Angeles County (County) to lease approximately 0.14 acres of County-owned land, located at 1173 North Loma Vista Drive (Premises). The Premises has been developed into Loma Vista Park, a mini park with a lawn area, trees, seating, and a play structure with a rubberized tot lot surface. In 2007, the Arts Council of Long Beach, together with a local artist and nearby school students, incorporated the manhole covers in a mosaic design of the sun and solar system. Loma Vista Park has added much needed open space in an area that is underserved and offers residents access to a walkable and bikeable neighborhood park.

 

The current term of the lease is set to expire on May 13, 2023. Both the County and the City desire to extend the lease to continue providing much-needed recreation area that benefits local residents and the surrounding neighborhoods. A First Amendment to the lease has been negotiated to extend the term for a period of twenty (20) years through May 13, 2043, for a one-time rent payment in the amount of One Thousand Dollars ($1,000).

 

On April 20, 2023, the Parks and Recreation Commission recommended to the City Manager the approval of the First Amendment to Lease No. 28338. The terms and conditions of the First Amendment include the following:

 

                     Lessor: County Sanitation District No. 3 of Los Angeles County.

 

                     Lessee: City of Long Beach, a municipal corporation.

 

                     Premises: 1173 North Loma Vista Drive, consisting of approximately 0.14 acres.

 

                     Use: Loma Vista Park, a mini park that includes a lawn area, trees, seating, and a play structure with a rubberized tot lot surface.

 

                     Rent: One-time rent payment of $1,000, for the subsequent 20-year term of the Lease, due within 30 days after the First Amendment effective date.

 

                     Term: Twenty (20) years commencing on May 14, 2023, and expiring on May 13, 2043.

 

                     Renewal Options: None.

 

This matter was reviewed by Principal Deputy City Attorney Richard Anthony on April 11, 2023 and by Budget Management Officer Nader Kaamoush on April 12, 2023.

 

 

TIMING CONSIDERATIONS

City Council action is requested on May 2, 2023, to facilitate the execution of the First Amendment to Lease Agreement No. 28338 prior to the current expiration date.

 

FISCAL IMPACT

The City agrees to a one-time rent payment in the amount of $1,000 for the 20-year lease expiring May 13, 2043. The one-time payment will be absorbed in the General Fund Group in the Parks, Recreation and Marine Department. The ongoing maintenance for Loma Vista Park is estimated at $851 per year and is currently budgeted in the General Fund Group in the Parks, Recreation and Marine Department. This recommendation has no staffing impact beyond the normal budgeted scope of duties. There is no local job impact associated with this recommendation.
