TITLE

Recommendation to adopt Plans and Specifications No. R-7171 and award a contract to Powell Constructors Inc., of Fontana, CA, for the I-605 Soundwall Project, in an amount of $2,073,095, authorize a 15 percent contingency in the amount of $310,964, for a total contract amount not to exceed $2,384,059; and, authorize City Manager, or designee, to execute all documents necessary to enter into the contract, including any necessary amendments;

 

Increase appropriations in the Capital Projects Fund Group in the Public Works Department by $1,300,000, offset by Los Angeles County Metropolitan Transportation Authority Measure R Highway Sub-Regional Program Grant funds (MR315.60);

 

Increase appropriations in the Capital Projects Fund Group in the Public Works Department by $1,300,000, offset by transfer of the Los Angeles County Metropolitan Transportation Authority Measure R Highway Sub-Regional Program Grant funds from the Capital Grant Fund; and

 

Accept Categorical Exemption No. CE-20-017.  (District 4)

 

DISCUSSION

City Council approval is requested to enter into a contract with Powell Constructors, Inc., for the construction of the I-605 Soundwall Project (Project). The Project is a recommended I-605 Early Action Project to construct approximately 883 linear feet of soundwall between the Coyote Creek Channel and East Spring Street (Attachment A).  The purpose of this Project is to preserve and enhance the health and quality of life in the corridor, and to remedy a noise issue resulting from removal of trees by Caltrans that had previously served as a noise barrier for the El Dorado Lakes condominium development.

 

On August 25, 2015, the original funding agreement for $250,000 in Measure R Early Action funds for environmental work was approved by the Gateway Cities Council of Governments (GCCOG) and by Los Angeles County Metropolitan Transportation Authority (Metro) Board of Directors on December 4, 2015.

 

On November 7, 2016, the original Funding Agreement with Metro, under the authority of City Council Resolution No. RES-16-0099, was executed and formalized the terms and conditions for use of Project Measure R funds. On February 21, 2017, the City Council approved an appropriation increase of $250,000 for design.

 

On August 22, 2017, an additional $100,000 in Measure R Early Action funds was approved by the GCCOG and by Metro on October 26, 2017, for a total of $350,000.  On March 13, 2018, the City Council approved an appropriation increase to $350,000 for design.

 

On February 25, 2020, an additional $2,819,033 in Measure R Early Action funds were approved by the GCCOG and approved by Metro on June 25, 2020 for a total of $3,169,033. On October 6, 2020, the City Council approved an appropriation increase to $3,169,033 for final design, construction, and other associated costs in accordance with the I-605 Corridor Aesthetic Master Plan.

 

On October 26, 2021, an additional $1,300,000 in Measure R Early Action funds were approved by the GCCOG and approved by Metro on January 19, 2022 for a total of $4,469,033 for construction and additional Caltrans Project requirements.

 

This bid was advertised in the Long Beach Press-Telegram on September 24, 2022, and 14 potential bidders specializing in construction services, materials, and supplies were notified of the bid opportunity.  Of those bidders, 10 downloaded the bid via the City’s electronic bid system.  The bid announcement was made available from the Purchasing Division, located on the sixth floor of City Hall, and the Division’s website at www.longbeach.gov/purchasing <http://www.longbeach.gov/purchasing>.  A bid announcement was also included in the Purchasing Division’s weekly update of Open Bid Opportunities, which is sent to 42 local, minority, and women-owned business groups.  One bid was received on November 15, 2022.  The bidder is not a Minority-owned Business Enterprises (MBE), Women-owned Business Enterprises (WBE), or a certified Small Business Enterprises (SBE), and is not a Long Beach vendor (Local).  Powell Constructors, Inc., of Fontana, CA, was the sole bidder and is both responsive and responsible.

 

This matter was reviewed by Deputy City Attorney Vanessa S. Ibarra on December 28, 2022, Purchasing Agent Michelle Wilson on December 22, 2022, and by Budget Management Officer Nader Kaamoush on December 30 2022.

 

ENVIRONMENTAL CLEARANCE

In conformance with the California Environmental Quality Act, Categorical Exemption CE-20-017 was issued for this project (Attachment B) on January 1, 2020, which the Public Works Department is asking City Council to accept.

 

TIMING CONSIDERATIONS

City Council action to adopt Plans and Specifications No. R-7171 and award a contract concurrently is requested on January 17, 2023, to ensure the contract is in place to start construction expeditiously.

 

FISCAL IMPACT

The total amount of the contract will not exceed $2,384,059, inclusive of a 15 percent contingency.  The total project cost is estimated at $4,138,670, inclusive of the contract and contingency, design, construction, construction management, materials testing, labor compliance, project oversight, and inspections.  The project is currently supported by $3,169,033 from Los Angeles County Metropolitan Authority Measure R Grant and $40,000 of Measure A funds, which are currently appropriated in the Capital Projects Fund Group in the Public Works Department. An additional $1,300,000 of Los Angeles County Metropolitan Authority Measure R Grant funding is requested to support the Project in the recommendation.

 

An appropriation increase in the amount of $2,600,000 is requested in the Capital Projects Fund group in the Public Works Department.  Of this amount, $1,300,000 will be offset with reimbursement revenues received from Metro. The remaining $1,300,000 is a technical appropriation to allow for the transfer of Metro grant funds from the Capital Projects Grants Fund.

 

This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities.  The number of additional local jobs created by this project will not be known until contractors have completed their hiring and construction has commenced.
