TITLE
Recommendation to authorize City Manager, or designee, to execute all documents necessary to amend Contract No. 34352 with United Storm Water, Inc., of City of Industry, CA, for routine storm drain maintenance and repair, and extend the term of the contract to April 30, 2023. (Citywide)
DISCUSSION
City Council approval is requested to amend Contract No. 34352 with United Storm Water, Inc. (USW), to continue providing routine storm drain maintenance and repair through April 30, 2023.
On August 2, 2016, the City Council adopted Specifications No. RFP PW16-131 and awarded a contract to USW to provide routine maintenance and repair services on City of Long Beach’s (City) storm drains, in an annual amount of $276,000, and authorized an annual 25 percent contingency in the amount of $69,000, for a total annual contract amount not to exceed $345,000, for a period of three years, with the option to renew for two additional one-year periods. On May 23, 2017, the City Council authorized an amendment to Contract No. 34352 to increase the contractual authority by $710,000, for a revised total three-year contract amount not to exceed $1,745,000, to cover one-time costs associated with emergency storm calls that took place December 2016 to February 2017, and the preparation work done for pump station rehabilitation as recommended by a 2015 assessment study. On March 10, 2020, the City Council authorized an amendment to Contract No. 34352 to increase the contractual authority by $1,269,045, for a total amount not to exceed of $3,359,045. On August 3, 2021, the City Council authorized an amendment to Contract No. 34352 to increase the contract amount by $1,000,000, for a total amount not to exceed $4,704,045, and extended the term of the contract to April 30, 2022. On April 12, 2022, the City Council authorized an amendment to Contract No. 34352 and extended the term of the contract to September 30, 2022.
The contract includes the annual maintenance, repairs, modifications, as-needed emergency response, and other services needed for the storm drain system. The system must be regularly maintained to minimize flooding during storm events, thereby protecting property from damage and providing for the general safety, health, and welfare of Long Beach residents. Additionally, the City’s municipal storm drain system is required to be kept in working order to reduce bacteria and pollutants in storm water runoff into the Los Angeles River.
The unexpected effects created by staffing changes and overseeing other priority programs impacted the capacity and ability of Public Works Department staff to prepare and release a formal Request for Proposals (RFP). Extending the term of the contract through April 30, 2023, will provide additional time for staff to complete a competitive procurement process in accordance with the City’s procurement policies without an interruption to services. This amendment will provide adequate resources to ensure continuity of service and availability of as-needed maintenance and services in preparation for the next rain season.

TIMING CONSIDERATIONS
City Council action to amend Contract No. 34352 is requested on December 6, 2022, to ensure there is no interruption in service.
FISCAL IMPACT
There is no fiscal impact from amending this contract. The requested action will only extend the term of the contract through April 30, 2023. Sufficient appropriation for the routine storm drain maintenance and repair is budgeted in the General Fund Group in the Public Works Department. Any work not currently budgeted will only proceed at such time as appropriations have been approved by the City Council. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. This recommendation will continue to provide support to the local economy by assisting in the preservation of employment for six full-time employees residing in Long Beach.
