TITLE

Authorize City Manager, or designee, to execute all documents necessary with Long Beach City College Foundation for the use of stadium facilities for COVID-19 testing and vaccination for the duration of the COVID-19 emergency; and

 

Increase appropriations in the Health Fund Group in the Health and Human Services Department by $206,519, offset by grant revenue.  (Citywide)

 

DISCUSSION

On March 10, 2020, the City Council recognized that an emergency existed and unanimously passed a Resolution ratifying the City Manager’s Proclamation of Local Emergency and the Public Health Officer’s Declaration of Local Health Emergency due to the COVID-19 pandemic.  Pursuant to LBMC Chapters 2.69 and 2.85, the City Manager has the authority to approve purchases of up to $1,000,000 for goods or services related to a proclaimed emergency.

 

In response to the serious and imminent threat of an outbreak of COVID-19, it was determined that the City of Long Beach needed to enter into rental/lease agreements with Long Beach City College Foundation (Long Beach City College) for the use of parking lots and building facilities to set up emergency COVID-19 testing and vaccination responses, as well as activating the mobile hospital as a Rapid Assessment Clinic.  On April 3, 2020, the Facility Use Agreement was conformed with Long Beach City College.  As the Proclamation of Local Emergency is extended, the lease agreement with Long Beach City College continues to be amended.  The First amendment added language for handling medical or biohazard waste to the agreement.  The Second amendment extended the term and updated the agreement to reflect the current lots and buildings in use.  The Third amendment added parking lots for a food giveaway event on July 17, 2020.  The Fourth amendment extended the term and updated the language around fees.  The Fifth amendment added language for mass vaccination flu clinics in the fall of 2020.  The Sixth amendment extended the term of the agreement and updated the map.  The  Seventh amendment added language to allow for more scheduling flexibility, and is pending approval.  The Eighth amendment was originally intended for a pop-up clinic at the Pacific Coast Campus on April 7, 2021; however, the site was not used and therefore the amendment was never executed.  The Ninth amendment extended the lease through March 31, 2022, and services have been extended through September 30, 2022.  Additional amendments are anticipated to occur and are initiated by Long Beach City College in furtherance of providing COVID-19 vaccines to the community.

 

This matter was reviewed by Deputy City Attorney Taylor M. Anderson on August 23, 2022, and by Budget Analysis Officer Greg Sorensen on September 16, 2022.

 

TIMING CONSIDERATIONS

City Council action is requested on October 4, 2022, to ensure that the City is in compliance with Long Beach City College and can continue to use the lots for COVID-19 testing and vaccination sites.

 

FISCAL IMPACT

The requested action authorizes a contract amount of $755,000 through September 30, 2022.  Currently, $250,000 is covered through the CDC Epidemiology and Laboratory Capacity Grant and $298,481 is covered through the Immunization Program Grant Funding Rounds 3 and 4 from the State, all of which are currently budgeted in the Health Fund Group in the Health and Human Services Department.  The additional $206,519 is eligible for cost recovery under the FEMA Public Assistance (PA) program.  As the FEMA funding is unbudgeted, an appropriation increase is being requested in the amount of $206,519 in the Health Fund Group in the Health and Human Services Department.  Any indirect costs that might not ultimately be eligible for grant funds will be funded by the Health Operating Fund, General Fund, or other eligible grant funds.  No match or in-kind service mandate is required.  This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities.  There is no local job impact associated with this recommendation.
