TITLE
Recommendation to authorize City Manager to execute all necessary documents pertaining to the widening of Pacific Coast Highway at Second Street, including an easement for street purposes to be granted to CALTRANS and a Release and Indemnification Agreement with CALTRANS. (District 3)

DISCUSSION
The Department of Public Works (PW) is in the process of widening the intersection of Pacific Coast Highway at Second Street as recommended in the Marina Shores Environmental Impact Report of 1998. Project design is complete for this project, which is to be built with Transportation Mitigation Program Funding. This street widening will necessitate the partial acquisition of adjoining real property. On October 20, 2009, City Council adopted a Resolution of Necessity to determine the public interest and necessity for acquiring and authorized the condemnation of the property needed for the widening. A copy of the council letter is attached.

As Pacific Coast Highway is a California State (Caltrans) highway, this project must be done in collaboration with Caltrans. In order to receive the necessary street construction permit, Caltrans requires that the City execute a Release and Indemnification Agreement protecting them against liabilities associated with any hazardous materials that might be found on the project site, as well as general liability for the construction of the roadway improvements. After construction is complete, the City of Long Beach shall grant an easement to Caltrans making the additional street width a part of Pacific Coast Highway.

In conformance with the California Environmental Quality Act, Mitigated Negative Declaration Number ND-25-07 was issued for this street-widening project.
