DISCUSSION
Two City-owned corrugated metal storm drain pipes were installed in 1961 within the Temple Avenue Bridge over the San Diego Freeway when the freeway was constructed. The purpose was to convey storm flows northerly across the freeway to a storm drain system located in Spring Street. During a bridge inspection, Caltrans noticed evidence of water damage to the bridge structure and, after further investigation, determined that these City-owned storm pipes had deteriorated and needed to be immediately replaced to prevent further water damage to the bridge structure. The bridge was subsequently closed to traffic and an emergency contract was issued to install two temporary 42-inch pipes across the top of the bridge until a contract could be awardedi for the permanent replacement of these deteriorated pipes.  The contract for the permanent replacement of these deteriorated pipes was awarded by the City Council on August 4, 2009, to Peterson-Chase General Engineering Construction, Incorporated, for the amount of $1,150,000.
 
At the time of award, the City was still in discussions with Caltrans and the City of Signal Hill regarding possible funding contributions to offset the cost of these pipe replacements. Since then, the City of Signal Hill has committed to a $30,000 contribution, and Caltrans has committed to a $147,000 contribution.
 
This matter was reviewed by Deputy City Attorney Linda Trang on September 30, 2009 and by Budget and Performance Management Bureau Manager David Wodynski on October 1 , 2009.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on October 20, 2009, to permit the acceptance of these funds. Construction is currently ongoing.
 
FISCAL IMPACT
When City Council approved the construction contract on August 4, 2009, sufficient funding was in place and potential funding contributions from Caltrans and City of Signal Hill were being discussed. Confirmation has been received from both agencies with Caltrans and Signal Hill's contribution amounts of $147,000 and $30,000 respectively.  An appropriation increase of $177,000 is requested in the Gas Tax Street Improvement Fund (SR 181) in the Department of Public Works (PW).
