DISCUSSION
City Council approval is requested authorizing the City Manager to execute a contract for the purchase of two John Deere 850J LGP Crawler Dozers for the Department of Parks, Recreation and Marine, Maintenance and Development Bureau. This purchase will be replacing two existing units that range in an age from 11 to 19 years old, with a scheduled lifecycle of 6 years.
 
The Department of Public Works, Fleet Services Bureau, is requesting to purchase two John Deere 850J LGP Crawler Dozers as part of the 2009 replacement schedule in order to meet the deadline of March 1, 2010, to bring the City's off-road equipment to emissions compliant levels, as well as provide the necessary equipment for the City's Beach Re-nourishment Program. This will be achieved by replacing the older equipment with the new State of California Air Resources Board (CARB) certified powered equipment. The new dozers will be issued to the Department of Parks, Recreation and Marine, Maintenance and Development Bureau, as the primary equipment used to repair erosion on the City's shoreline. This equipment is critical for building the berms necessary to protect residences and businesses on the City's shoreline year-round, but especially during the winter months.
 
The Department of Public Works, Fleet Services Bureau, in conjunction with the Department of Financial Management's Purchasing Division, investigated procurement options and learned that the State of California had completed a competitive bid process in April 2009 for dozers and has a contract with Bragg Investment Company, Inc., dba Coastline Equipment Company of Long Beach, CA (local) that meets the Fleet Services Bureau's needs.
 
The City Charter provides an alternative procurement method by permitting the City to purchase or otherwise obtain services, supplies, materials, equipment and labor with other governmental agencies by purchasing under their contracts on a voluntary and selective basis when authorized by a Resolution of the City Council.
 
Bragg Investment Company, Inc., dba Coastline Equipment Company has agreed to sell two John Deere Crawler Dozers to the City of Long Beach under the same terms and conditions as are afforded to the State of California. The Matrix Fleet Review Study also supports the use of cooperative purchase agreements and adherence to a long-term replacement plan.
 
This matter was reviewed by Deputy City Attorney Amy R. Burton on September 22, 2009 and Budget and Performance Management Bureau Manager David Wodynski on September 28, 2009.
 
TIMING CONSIDERATIONS
City Council action to adopt the attached Resolution is requested on October 20, 2009 to ensure that the contract is in place expeditiously to minimize delivery turnaround time and have this critical equipment in place for the winter season.
 
FISCAL IMPACT
The cost of this contract is $574,273 including tax, and is budgeted in the Fleet Services Fund (IS 386) in the Department of Public Works (PW). Costs were recovered from the Department of Department of Parks, Recreation and Marine, Maintenance and Development Bureau, through monthly capital replacement recovery charges to support this purchase.
