TITLE
Recommendation to authorize City Manager, or designee, to execute all documents necessary to enter into a Non-Federal Reimbursable Agreement with the Federal Aviation Administration, in an amount not to exceed $140,601, to provide the shutdown and restoration of technical operations support for Taxiway L Airfield improvements at the Long Beach Airport. (District 5)
DISCUSSION
On July 7, 2020, the City Council authorized the acceptance of the Federal Aviation Administration (FAA) Airfield Improvement Program (AIP) Grant for Fiscal Year 2020 (FY 20), if awarded, to fund the Taxiway L Reconstruction Project (Project). Since then, the AIP grant awards for FY 20 were received and the bid advertisement for the Project has been conducted.
Taxiway L serves as the primary taxiway for all departing commercial aircraft and is also used by air cargo carriers. Taxiway L has exhibited accelerated pavement damage (in structural subgrade), presumably due to the limitations of compaction over the Lakewood Boulevard and Spring Street tunnels. The Long Beach Airport (Airport) has performed numerous emergency surface repairs to prevent foreign object debris. The Project will reconstruct Taxiway L and the connectors using Portland Cement Concrete (PCC). Improvements to the primary air carrier taxiway will preserve safety and capacity.
In support of the Project, the FAA will provide a technician to shut down and restore the associated Navigational Aids (NAVAIDs), Visual Aids (VISAIDs), and any other FAA-owned equipment as necessary during construction. The agreement will require an advance payment to FAA for the entire estimated cost for FAA overtime and travel expenses related to the work, in an amount not to exceed $140,601. Upon project completion, the final costs will be netted against the advance payment and, as appropriate, a refund or final bill will be issued to the City. Expenses incurred will be reimbursed by the FAA AIP Grant No. 3-06-0127-048-2020 (AIP-48). The agreement will also include additional terms, scope revisions, insurance, and miscellaneous requirements acceptable to both parties.

TIMING CONSIDERATIONS
City Council action is requested on April 13, 2021, to ensure the agreement is in place expeditiously to allow for payment within the timeframe required by the FAA.
FISCAL IMPACT
The Non-Federal Reimbursable Agreement with the FAA is estimated to cost $140,601 for work related to the shutdown and restoration of technical operations support for the Project. Advanced payment to the FAA is required and will be reimbursed by funding received from the FAA grant AIP-48. The grant is not currently appropriated. The Department will return to City Council with a request to appropriate the grant at the time it awards the construction project. In the event that the FAA requests payment prior to the approval of an appropriation increase for the grant, payment will be funded within existing resources currently budgeted in the Airport Fund Group in the Airport Department. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
