DISCUSSION

City Council approval is requested to enter into an agreement with the Los Angeles County Flood Control District (LACFCD), to accept and expend funding from the Safe, Clean Water Program’s Municipal Program Transfer Agreement No. 2020MP46, in the amount of $4,460,000 annually.

 

On April 5, 2016, the Los Angeles County Board of Supervisors passed a motion directing the Los Angeles County Department of Public Works, in coordination with other County departments, cities, local water agencies, business stakeholders, nonprofit organizations, school districts, and other regional stakeholders, to design and develop a Drought Resilience Plan. This led to the creation of the Safe, Clean Water Program (SCWP), a parcel tax known as Measure W, to be implemented by the LACFCD. The purpose of the SCWP is to develop and implement projects and programs to increase stormwater capture and reduce stormwater and urban runoff pollution.  SCWP is to be funded by a parcel tax in the amount of two and one-half cents ($0.025) per square-foot of impermeable area in Los Angeles County. The SCWP parcel tax measure was placed on the November 6, 2018 election ballot and approved by the voters.

 

Based on the estimated impervious areas in Long Beach, the City of Long Beach (City) is to generate approximately $11,150,000 in annual tax revenue, which will be allocated in accordance with the SCWP as follows:

 

 

The Municipal Program provides approximately $4,460,000 of local return funds directly to the City to implement projects and programs related to the SCWP, in accordance with Chapters 16 and 18 of the LACFCD Code, also known as the SCWP Implementation Ordinance.  Of the $4,460,000, 70 percent is programed for Capital Improvement Projects, and the remaining 30 percent is programmed to support operating costs. The funds will allow the City to advance compliance with the State of California’s MS4 Permit, the goal of which is to capture, treat, and re-use stormwater.

 

This matter was reviewed by Deputy City Attorney Amy R. Webber on August 31, 2020 and by Budget Analysis Officer Julissa José-Murray on September 17, 2020.

 

TIMING CONSIDERATIONS

City Council action is requested on October 6, 2020, to secure the City's participation in the LACFCD SCWP Municipal Program.

 

FISCAL IMPACT

The FY 21 SCWP Municipal Program revenue has been addressed as part of the Adopted FY 21 Budget in the Capital Fund Group in the Public Works Department. Sufficient appropriation to support this recommendation is appropriated in the Capital Projects Fund Group (Measure W).  Subsequent years will be addressed as part of the annual budget process.  This recommendation has no staffing impact beyond the normal budged scope of duties and is consistent with existing City Council Priorities.  There is no local job impact associated with this recommendation.
