DISCUSSION
The Boeing Company is in the process of making off-site traffic mitigations for the development of Douglas Park. In order to provide an additional right-turn lane at the northeast corner of the intersection of Cherry Avenue and Cover Street, it is necessary to acquire an additional right-of-way for street purposes. The Boeing Company has an agreement with the owner of the property, addressed as 3850 Cherry Avenue, for the dedication of the right-of-way needed to make this street improvement, which cannot be built until the right-of-way is acquired. The area to be dedicated is shown on Exhibit A.
 
In conformance with the California Environmental Quality Act, Environmental Report No.
2001051048 was certified for this project.
 
This matter was reviewed by Deputy City Attorney Linda Trang on July 6, 2009, and Budget and Performance Management Bureau Manager David Wodynski on July 21, 2009.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A document processing fee of $1 ,057 was paid by the Boeing Company and deposited in the General Fund (GP) in the Department of Public Works (PW).
