TITLE
Recommendation to authorize City Manager, or designee, to accept an easement deed from The Long Beach 4th Street LP, a Delaware limited partnership, and the owners of the property at 1220 East 4th Street, for the installation of public utilities; and
Accept Categorical Exemption Number CE-19-158. (District 2)
DISCUSSION
The Long Beach 4th Street LP, a Delaware limited partnership, and the owner of the property at 1220 East 4th Street, has completed tenant improvements to the existing 16,000-square-foot building that is currently being used as an adult day care facility. To accommodate the improvements and modifications, it is necessary that an easement be granted to the City to allow for the installation of a double-check detector valve (Attachment A). This device provides backflow prevention to protect water supplies from contamination. The Department of Public Works is asking the City Council to authorize acceptance of an easement deed to accomplish this purpose.
City staff conducted a review of the affected agencies and there were no objections to the proposed easement to be dedicated. In conformance with the California Environmental Quality Act (CEQA), Categorical Exemption Number CE-19-158 was issued on May 31, 2019 (Attachment B). The Department of Public Works is asking the City Council to accept CEQA Categorical Exemption Number CE-19-158.
This matter was reviewed by Deputy City Attorney Erin Weesner-McKinley on March 11, 2020 and by Revenue Management Officer Geraldine Alejo on April 20, 2020.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
An easement processing fee in the amount of $3,195 was deposited in the General Fund Group in the Public Works Department. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
