TITLE

Recommendation to authorize the Department of Development Services to process a refund in the amount of $156,575 to the Harbor Department for the property located at 3445 New Dock Street.

DISCUSSION

On August 9, 2019, the Harbor Department paid $198,458 from their escrow account to cover multiple plan check fees related to a permit to realign an existing track and construct a new 5,000-square foot lead track near the Total Terminals International property at 3445 New Dock Street. Due to a valuation miscalculation, the applicant was overcharged $156,575, and should receive a refund in that amount. 

 

In accordance with the Long Beach Municipal Code Section 3.48.040, which requires  refunds exceeding $10,000 be approved by the City Attorney and the City Council, authorization to process the refund is requested on behalf of the applicant.

 

This matter was reviewed by Assistant City Attorney Michael J. Mais on November 6, 2019 and by Budget Analysis Officer Julissa José-Murray on November 15, 2019.

 

TIMING CONSIDERATIONS

City Council action is requested on December 10, 2019, to expedite processing of the refund.

 

FISCAL IMPACT

The $156,575 in plan check fees will be refunded from the Development Services Fund Group in the Department of Development Services.

 

This recommendation has no staffing impact beyond the budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
