TITLE

Authorize City Manager, or designee, to execute an Installation and Maintenance Agreement (IMA) with PCH Property, LLC, a Delaware limited liability corporation, for hardscape and landscape maintenance purposes within State highway right-of-way on Route 1 within the City of Long Beach; and

Authorize City Manager, or designee, to execute an Installation and Maintenance Agreement (IMA) with PCH Property, LLC, a Delaware limited liability corporation, for hardscape and landscape maintenance purposes on Marina Drive between 2nd Street and Studebaker Road. (District 3)

DISCUSSION
PCH Property, LLC, owner of the property at 6400 Pacific Coast Highway is constructing hardscape and landscape improvements within both the Caltrans and City rights-of-way. Caltrans will not enter into a maintenance agreement directly with the property owner. Therefore, Caltrans requires that an agreement be in place between the City and Caltrans prior to issuance of the Caltrans permit to the property owner. A separate agreement between the property owner and the City ensures the property owner is responsible for the requirements as outlined within the Caltrans agreement. A third agreement, between the property owner and the City ensures the landscape and hardscape improvements made along Marina Drive are maintained by the property owner.
