Recommendation to authorize City Manager, or designee, to execute all documents necessary for a First Amendment to Revocable Permit No. 30731 with the Los Angeles County Flood Control District, for the continued use of City-owned property along the west bank of the Los Angeles River, south of Ocean Boulevard, for temporary storage of collected trash/debris, through April 15, 2028, with one, five-year renewal option, at the discretion of the City Manager. DISCUSSION
On March 18, 2008, the City Council authorized Revocable Permit No. 30731 (Permit) with the Los Angeles County Flood Control District (County) for the continued use of 38,880 square feet of vacant City-owned property along the west bank of the Los Angeles River (River), south of Ocean Boulevard (Permit Area). Since 1999, the County has used the Permit Area to temporarily store trash and semi-submerged debris that has been separated from the River by a trash boom, which also originates from the Permit Area. The County’s use of the Permit Area and operation of the corresponding trash boom serves a vital role in the removal of trash and debris, which would otherwise enter the ocean and compromise water quality at local beaches, harbors, and aquatic habitats.
The initial term of the Permit has expired and the County confirmed that it is interested in extending the Permit. To memorialize and facilitate an extension, a First Amendment to the Permit is be required. The Economic Development Department has negotiated an amendment to the Permit that contains the following amended terms:
· Amended Term: The amended term of the Permit will be for a period of ten years, through April 15, 2028.
· Renewal Options: The term of the Permit may be extended for one additional period of five years, at the discretion of the City Manager.
· Permit Fee: As consideration for the continued use of the Permit Area, the County will pay an annual Permit Fee of $1, which is unchanged from the current Permit...
