TITLE

Recommendation to authorize City Manager, or designee, to amend Contract No. 35039 with Sully-Miller Contracting Company, of Brea, CA, for additional street improvements to 3rd Street and Broadway, between Magnolia Avenue and Alamitos Avenue, to increase the contract amount by $304,000, for a revised total contract amount not to exceed $4,871,200.  (District 1,2)

DISCUSSION

On June 19, 2018, the City Council awarded a contract to Sully-Miller Contracting Company, for street improvements to 3rd Street and Broadway, between Magnolia Avenue and Alamitos Avenue (Project).  The Project provides pedestrian-oriented improvements, which include new sidewalks, continental crosswalks, signage, bus stop islands, and parking-protected bike facilities.

During construction of the Project, additional removal and reconstruction of sidewalks and curb ramps were required for American with Disabilities Act (ADA) compliance.  Solutions were engineered and change orders negotiated, which increased the Project cost and duration.

This matter was reviewed by Deputy City Attorney Amy R. Webber on June 4, 2019, and by Purchasing Agent Tara Yeats and Budget Analysis Officer Julissa José-Murray on July 24, 2019.

TIMING CONSIDERATIONS

City Council action is requested on August 20, 2019, to ensure timely Project completion.

FISCAL IMPACT

The revised total contract amount will not exceed $4,871,200.  There is sufficient appropriation in the Capital Projects Fund Group in the Public Works Department to support the $304,000 increase to the contract.  This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities.  There is no local job impact associated with this recommendation.

SUGGESTED ACTION

Approve recommendation.
