DISCUSSION
Since January 1,2005, Steve Aichele, dba Pacific Coast Tank (PacTank), has provided professional services as a designated Underground Storage Tank Operator licensed by the State of California. The Department of Public Works, Fleet Services Bureau, did not have staff with the expertise to comply with the regulatory rules and regulations and, therefore, sought to contract these services in order to achieve and maintain compliance with the California State Water Resources Board (CSWRB) and California Air Resources Board (CARB). As the rules and regulations evolve and associated technologies change, it is necessary that the City remain abreast of the changes with the help of a technical expert in the field.

A blanket purchase order was approved in the amount of $95,000 for the period October 1, 2008 through September 30,2009. Due to the unanticipated creation of a comprehensive Underground Storage Tank Compliance Plan and in order for PacTank to continue to provide their professional services on current projects, an additional $145,000 of contract authority is needed. In addition, the Fleet Services Bureau is requesting to extend the current Agreement through December 31,2009 while the development of a new scope of services is drafted and a Request for Proposals is conducted. The Department of Public Works intends to come back to City Council prior to December 31, 2009 to award a new Agreement. PacTank has been providing consulting services with the underground storage tank projects since 2005 with repairs ongoing at a number of sites.
