TITLE
Recommendation to authorize City Manager, or designee, to execute all documents necessary to issue a Right-of-Entry Permit to Shell Oil Products US, to obtain soil and vapor samples at the Fleet Services Bureau facility, at 2600 North Temple Avenue, for a period not to exceed five years. (District 5)
DISCUSSION
City Council approval is requested to authorize the City Manager to execute a Right-of-Entry Permit with Shell Oil Products US (Shell Oil), to grant access to the Fleet Services Bureau facility at 2600 North Temple Avenue (Site) to obtain soil and vapor samples from the area surrounding their underground pipelines. The Los Angeles Regional Water Quality Control Board (LARWQB) requires the area surrounding underground pipelines to be monitored for dissolved petroleum hydrocarbons in the groundwater.
On October 16, 2018, the Regional Water Quality Control Board (RWQCB) issued a letter to Shell Oil specifying that further testing was needed at the Site. Therefore, Shell Oil is requesting access to the Site for further testing. Shell Oil had a previous Right-of-Entry Permit to collect soil, vapor, and groundwater samples for RWQCB that has since expired. There will be no costs to the City during the testing and analysis process.
This matter was reviewed by Deputy City Attorney Taylor M. Anderson on March 19, 2019, and by Budget Management Officer Rhutu Amin Gharib on April 3, 2019.
TIMING CONSIDERATIONS
City Council action is requested on April 23, 2019, to ensure the permit is in place expeditiously.
FISCAL IMPACT
There is no fiscal or local job impact associated with this recommendation. This recommendation has minimal staffing impact beyond the normal budgeted scope of duties and is consistent with existing Council priorities.
