TITLE
Recommendation to authorize the Financial Management Department to process a refund in the amount of $16,804 to GC CA Ventures, LLC, at 2165 West 16th Street. (District 1)
DISCUSSION
On February 15, 2019, GC CA Ventures, LLC, made a cash payment of $16,804 for their annual medical cannabis cultivation business license tax. That same day, a mailed check was processed for $16,804 for the same license account. Pursuant to Long Beach Municipal Code (LBMC) Section 3.80.427.5, a business is eligible for a refund of the business license tax if it is paid more than once for the same term. Due to this duplicate payment of the business license tax, the business is eligible for a refund.
LBMC Section 3.48.040 requires refunds exceeding $10,000 be authorized by the City Attorney and City Council. The Financial Management Department has reviewed the request and recommends the refund be granted.
This matter was reviewed by Deputy City Attorney Amy R. Webber on March 5, 2019 and by Budget Management Officer Rhutu Amin Gharib March 1, 2019.
TIMING CONSIDERATIONS
City Council action is requested on April 2, 2019, to expedite processing of the refund.
FISCAL IMPACT
The amount of $16,804 will be refunded from the General Fund (GF) in the Financial Management Department (FM). There is no local job impact associated with this recommendation.
