TITLE

Recommendation to authorize City Attorney to pay sum of $845,000 in full settlement of lawsuit entitled Estate of Juan Manuel Avila, et al. v. City of Long Beach; United States District Court Case No. 2:17-cv-05607-AB-JPRx.

DISCUSSION

Plaintiffs bring this action alleging that Long Beach Police officers used

unreasonable force against Juan Manuel Avila, Jr., which resulted in Mr. Avila's

death.

Following extensive negotiations, plaintiffs agreed to accept $845,000.00 -

inclusive of attorneys' fees and costs - as a full, global settlement of this case.

The settlement was discussed in closed session, and approved, by the

Economic Development and Finance Committee on January 22, 2019.

SUGGESTED ACTION

Approve recommendation.
