TITLE

Recommendation to authorize City Attorney to pay the sum of $6,000 in full settlement of lawsuit entitled John Hokanson, by and through his Guardian ad Litem Margaret Hokanson, Case No. NC051084.

DISCUSSION

On April 11, 2007, Plaintiff, a 16-year old, fell while riding a skateboard and severely fractured his left femur.  Plaintiff claims that the sidewalk was in a dilapidated condition creating a danger to persons using the sidewalk, and that the dangerous conditions of the sidewalk caused his fall.

Following settlement discussions at a Court ordered settlement conference a tentative settlement of $6,000 was reached.  The proposed settlement was presented to the Economic Development and Finance Committee on May 5, 2009, and was approved on that date.  We therefore ask authority to pay the sum of $6,000 in full settlement of this lawsuit.

SUGGESTED ACTION

Approve recommendation.
