TITLE
Recommendation to authorize an amendment to Contract No. 29391 with Earth Tech, Inc. (Earth Tech) to expend additional funds in the amount of $360,435 through September 30, 2009, for the purpose of providing environmental consulting services at various fuel site locations. (Districts 4,5,6,8)

DISCUSSION
In 1994, five fuel sites located throughout the City were found to have impacted the soil and groundwater. At that time, the California Regional Water Quality Control Board (CRWQCB) opened cases for each site, and the City became responsible for testing and reporting to CRWQCB on a quarterly basis, and for a plan to address the impacts.

The testing process and CRWQCB reporting requirements are complex in nature and require technical expertise. The City has contracted with various outside engineering firms to perform these services over the years, and in May 2005, selected Earth Tech based on interviewing six firms responding to the City's Request for Proposal. Earth Tech was awarded the contract for a three-year term, commencing September 30,2005, with two one-year extensions at the discretion of the City Manager. The contract is now in its fourth year and additional funds are needed to continue the reporting services. Earth Tech has performed well, effecting closure on one of the five affected sites and bringing the remaining sites into compliance with the CRWQCB.

Ongoing testing, monitoring and reporting expenses are expected to be incurred for current cases until the sites are legally closed. Additional expenses will be required to comply with directives issued by the CRWQCB to perform site assessments and to develop and implement requested activities.

This matter was reviewed by Deputy City Attorney Gary Anderson on May 7, 2009, and Budget and Performance Management Bureau Manager, David Wodynski on May 13, 2009.

TIMING CONSIDERATIONS
City Council authorization is requested on June 2, 2009, to allow compliance with CRWQCB directives.
