TITLE

Recommendation to authorize City Manager, or designee, to accept two easement deeds from Monte Riviera Property, LLC, a California limited liability company, the owner of the properties located at 4401 and 4411 East Pacific Coast Highway, for the installation of public utilities; and, accept Categorical Exemption 15-140 for a new Chick-Fil-A restaurant and Wells Fargo Bank branch.  (District 4)

 

DISCUSSION

Monte Riviera Property, LLC, a California limited liability company, owner of the properties at 4401 and 4411 East Pacific Coast Highway, is constructing a new Chick-Fil-A restaurant and a Wells Fargo Bank branch. To accommodate the new uses, it is necessary that two easements be granted to the City to allow for the installation of double-check detector valves (Exhibit A). These new lines will provide backflow prevention to protect water supplies from contamination.  Construction plans for the new businesses include installing water lines.

 

City staff conducted a review of affected agencies and there were no objections to the proposed easements. The proposed easements are in conformance with Categorical Exemption No. 15-140 (Exhibit B) for Chick-fil-A restaurant and Wells Fargo Bank branch new construction projects, issued January 4, 2016.

 

This matter was reviewed by Deputy City Attorney Linda T. Vu on December 11, 2017 and by Budget Analysis Officer Julissa Jose-Murray on December 15, 2017.

                                                                                                         

TIMING CONSIDERATIONS

City Council action on this matter is not time critical.

 

FISCAL IMPACT

Grants of easement processing fee in the amount of $2,108 was deposited in the General Fund (GF) in the Public Works Department (PW). There is no local job impact associated with this recommendation.

 

SUGGESTED ACTION

Approve recommendation.
