TITLE

Recommendation to adopt Plans and Specifications No. ITB PW17-096 and award a contract to The Public Restroom Company, of Minden, NV, for the furnishing and delivery of a prefabricated lifeguard station, in the amount of $480,851, and authorize a 10 percent contingency in the amount of $48,085, for a total contract amount not to exceed $528,936; and, authorize City Manager, or designee, to execute all documents necessary to enter into a contract, including any necessary amendments.  (District 3)

 

DISCUSSION

City Council approval is requested to enter into a contract with The Public Restroom Company, for the furnishing and delivery of a prefabricated lifeguard station to 5415 E. Ocean Boulevard. The prefabricated lifeguard station will replace an existing wood shed structure from which lifeguards currently operate, as well as an adjacent metal cargo container. The existing structure lacks a sanitary sewer connection, space to accommodate the treatment of first aid-related items to the public, and ADA access. The existing structure has extensive wood rot and will be demolished. The cargo container will be removed once the new prefabricated building has been installed, thus freeing up additional sand space. The new prefabricated lifeguard station will have 521 square feet for changing rooms, a restroom and shower for the lifeguards, storage space, and an area to provide first aid to the public. The City’s Job Order Contract (JOC) will provide installation of required site-related work and help coordinate delivery and installation with The Public Restroom Company.

 

The bid was advertised in the Long Beach Press-Telegram on June 8, 2017, and 8,379 potential bidders were notified of the bid opportunity.  Of those bidders, 36 downloaded the bid via the City’s electronic bid system.  The bid document was made available from the Purchasing Division, located on the seventh floor of City Hall, and the Division’s website at www.longbeach.gov/purchasing <http://www.longbeach.gov/purchasing>.  A bid announcement was also included in the Purchasing Division’s weekly update of Open Bid Opportunities, which is sent to 22 local, minority, and women-owned business groups.  One bid was received on July 13, 2017.  The Public Restroom Company, of Minden, NV (not an MBE, WBE, SBE or local business), was the sole responsible bidder.

 

Local Business Outreach

 

In an effort to align with the City’s outreach goal, Long Beach businesses are encouraged to submit bids for City contracts. The Purchasing Division also assists businesses with registering on the PlanetBids database to download the bid specifications. Through outreach, 853 Long Beach vendors were notified to submit bids, of which five downloaded and none submitted a bid.  The Purchasing Division is committed to continuing to perform outreach to local vendors to expand the bidder pool.

 

This matter was reviewed by Deputy City Attorney Linda T. Vu on August 29, 2017 and by Budget Analysis Officer Julissa José-Murray September 21, 2017.                     

 

TIMING CONSIDERATIONS

City Council action to adopt Specifications No. ITB PW17-096 and award a contract concurrently is requested on October 10, 2017, to start the project in a timely manner.

 

FISCAL IMPACT

The total cost of the project is estimated at $1,135,199 and includes the cost of purchasing the prefabricated lifeguard station, foundation and utilities site work, inspection, and administration services.  The total contract cost for the furnishing and delivery of the prefabricated restroom will not exceed $528,936, including a 10 percent contingency. Funds for this project are currently budgeted in the Tidelands Operations Fund (TF 401) in the Public Works Department (PW).  On May 24, 2012, the State Lands Commission (SLC) approved expenditures for the Project in the amount of $600,000. The SLC was notified on September 11, 2017 of the additional expenditures.  All SLC requirements have been met and the City is ready to proceed with the project.

 

The Fire Department provides the required operation and maintenance for the current facility and will continue to be responsible for the maintenance of the new lifeguard station. If additional funding for operational costs are necessary, a request may be made as part of the FY 19 budget process.  There is no local job impact associated with this recommendation.
