DISCUSSION
On December 20,2007, D'Orsay Partners International, LLC paid building permit fees and surcharges totaling $212,842 to develop the property located at 139 East Broadway. The applicant has withdrawn from the redevelopment project and is eligible for a refund (Long Beach Municipal Code Section 21.21.701) in the amount of $171 ,324.
 
In accordance with Long Beach Municipal Code, Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, an approval to process the refund is requested on behalf of the applicant.
 
This matter was reviewed by Assistant City Attorney Michael J. Mais on December 31, 2008 and by Budget and Performance Management Manager David Wodynski on January 5,2009.
 
TIMING CONSIDERATIONS
City Council action on this item is requested on February 3, 2009 to expedite processing of the refund.
 
FISCAL IMPACT
Strong Motion Implementation Program fees ($5,250) are refunded at 100 percent. The remaining fees ($207,592) are refunded at 80 percent. A total of $171,324 will be refunded from the Development Services Fund (SR 137) and the Development Services Department (DV) where the collected fees were deposited.
