DISCUSSION
In 2002, the California State Legislature passed Assembly Bill 117 creating Community Choice Aggregation (CCA), which allows cities, counties, and some special districts to aggregate the electrical buying power of individual customers within a defined jurisdiction. By aggregating the electrical load of individual customers into a single entity, CCAs are allowed to secure alternative energy supply contracts that offer customers a higher percentage of renewable energy than currently offered by traditional electric utilities. In addition to California, six other states have passed legislation allowing for electrical load aggregation. CCAs now serve approximately 5 percent of Americans in over 1,300 municipalities.

Residents and businesses within the City of Long Beach (City) currently purchase electricity from Southern California Edison (SCE). Pursuant to California Public Utilities Code Section 366.2, public utilities may provide confidential customer information for the purpose of investigating, pursuing, or implementing CCA services. To determine the feasibility of creating a CCA, along with estimating potential expenses and revenue, the Long Beach Gas and Oil Department must obtain electrical load data for SCE customers located within the City. Because certain information may be deemed confidential, SCE is requiring the City to enter into a non-disclosure agreement before releasing information.
