TITLE

Recommendation to adopt Plans and Specifications No. ITB CM17-035 and award contract to The Public Restroom Company, of Minden, NV, for the furnishing and delivery of a prefabricated restroom building at Marina Vista Park, in the amount of $327,505, and authorize a 10 percent contingency in the amount of $32,751, for a total contract amount not to exceed $360,256; and, authorize City Manager, or designee, to execute all documents necessary to enter into a contract, including any necessary amendments.  (District 3)

 

DISCUSSION

City Council approval is requested to enter into a contract with The Public Restroom Company, for the furnishing and delivery of a prefabricated restroom building at Marina Vista Park.  The existing Marina Vista Park restroom facility, consisting of four men’s stalls and four women’s stalls, is outdated and does not comply with current ADA requirements and California Assembly Bill 1732, requiring all single-user toilet facilities in any business establishment, place of public accommodation, or government agency to be identified as all-gender toilet facilities.  The building will have eight all-gender, individually accessed stalls.  Installation of the prefabricated restroom at Marina Vista Park will be handled through the City’s Job Order Contract (JOC), which is estimated to be in place in April 2017. 

 

The bid was advertised in the Long Beach Press-Telegram on January 10, 2017, and 4,274 potential bidders were notified of the bid opportunity.  Of those bidders, 36 downloaded the bid via the City’s electronic bid system.  The bid document was made available from the Purchasing Division, located on the seventh floor of City Hall, and the Division’s website at www.longbeach.gov/purchasing <http://www.longbeach.gov/purchasing>.  A bid announcement was also included in the Purchasing Division’s weekly update of Open Bid Opportunities, which is sent to 22 local, minority, and women-owned business groups.  One bid was received on February 23, 2017.  The Public Restroom Company, of Minden, NV (not an MBE, WBE, SBE or local), was the sole responsible bidder.

 

Local Business Outreach

 

In an effort to align with the City’s outreach goal, Long Beach businesses are encouraged to submit bids for City contracts. The Purchasing Division also assists businesses with registering on the PlanetBids database to download the bid specifications. Through outreach, 377 Long Beach vendors were notified to submit bids, of which two downloaded and none submitted a bid.  The Purchasing Division is committed to continuing to perform outreach to local vendors to expand the bidder pool.

 

This matter was reviewed by Deputy City Attorney Linda T. Vu on March 1, 2017 and by Budget Management Officer Rhutu Amin Gharib on March 7, 2017.

 

TIMING CONSIDERATIONS

City Council action to adopt Specifications No. ITB CM 17-035 and award a contract concurrently is requested on March 21, 2017, to ensure that the contract is in place expeditiously.

 

FISCAL IMPACT

The total contract cost for the furnishing and delivery of the prefabricated restroom will not exceed $360,256, including a 10 percent contingency. This amount is currently budgeted in the Tidelands Operations Fund (TF 401) in the Public Works Department (PW).  Installation costs are unknown at this time.  If additional appropriations are necessary to complete the project, the Public Works Department will return to City Council to request an increase in appropriations.  The State Lands Commission approved the expenditure of this funding on May 24, 2012, and no additional approvals are required.  There is no local job impact associated with this recommendation.
