TITLE

Recommendation to authorize City Manager, or designee, to execute a Public Walkways Occupancy Permit for sidewalk dining at Sancho’s Tacos restaurant, located at 5272 East Second Street.  (District 3)

 

DISCUSSION

The operator of Sancho’s Tacos restaurant, located at 5272 East Second Street, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining.  The proposed permit area and the list of furnishings to be placed in the permit area are shown on the attachment (Exhibit A).  Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.

 

The width of the sidewalk at this location is 13 feet 6 inches.  A minimum clearance along the sidewalk adjacent to the permit area will vary from 9 feet between barricade and curb, and 5 feet between the trash receptacle and barricade. Usage of the sidewalk dining area is restricted to the hours between 10:00 a.m. and 10:00 p.m.

 

The Coastal Development Permit allowing sidewalk dining on Second Street provides for a Public Walkways Occupancy Permit for businesses on Second Street from Livingston Drive to Santa Ana Avenue.

 

This matter was reviewed by Deputy City Attorney Linda T. Vu on January 3, 2017 and by Budget Analysis Officer Julissa José-Murray on January 18, 2017.

 

TIMING CONSIDERATIONS

City Council action on this matter is not time critical.

 

FISCAL IMPACT

A permit processing fee of $606 was deposited in the General Fund (GF) in the Public Works Department (PW), and a security deposit of $590 was collected to ensure sidewalk repairs upon permit termination.  Approval of this recommendation will provide continued support to the local economy.
