TITLE

Recommendation to authorize Development Services Department to process a refund in the amount of $15,240 to Inner Circle Investments for the property located at 4501 East Pacific Coast Highway.  (District 4)

 

DISCUSSION

On October 13, 2016, Inner Circle Investments (Applicant) paid fees totaling $15,240 to cover expenses and fees related to a Conditional Use Permit, Site Plan Review, and Categorical Exemption for a project at 4501 E. Pacific Coast Highway. The Applicant was charged for the incorrect type of applications and has since paid fees for the correct application. Therefore, in accordance with Long Beach Municipal Code (LBMC) Section 3.48.030, the Applicant is eligible for a full refund of $15,240.

 

In accordance with LBMC Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, authorization to process the refund is requested on behalf of the Applicant.

 

This matter was reviewed by Assistant City Attorney Michael J. Mais on November 29, 2016 and by Budget Management Officer Rhutu Amin Gharib on December 6, 2016.

 

TIMING CONSIDERATIONS

City Council action is requested on January 10, 2017, to expedite processing of the refund.

 

FISCAL IMPACT

The amount of $15,240 will be refunded from the Development Services Fund (EF 337) in the Development Services Department (DV). There is no local job impact associated with this recommendation.

 

SUGGESTED ACTION

Approve recommendation.
