TITLE
Recommendation to authorize City Attorney to pay the sum of $450,000 in full settlement of the lawsuit entitled SE Pipeline v. City of Long Beach, Case No. BC528493.
DISCUSSION
Plaintiff, SE Pipeline ("Plaintiff") entered into a written contract with the City to perform work on the City's natural gas pipeline system in several areas throughout the City. Plaintiff alleges that the City breached its contract with Plaintiff requiring Plaintiff to perform extra work and incur extra costs which the City did not pay. After three lengthy mediations, Plaintiff agreed to accept $450,000 as full settlement of this case, including attorney restitution and costs.
A presentation was made to the Economic Development and Finance Committee on Februarv 16, 2016, at which time the Committee voted to approve settlement of the above-referenced matter.
