TITLE
Recommendation to authorize City Manager to execute the First Amendment to Lease No. 23508 between the City of Long Beach, Stan Miller Yachts, Inc., a California corporation, and Bancap Marina Center, Inc., a California corporation, to delete all references to the use of slips designated to Stan Miller Yachts, Inc., since such slips no longer exist in the Alamitos Bay Marina. (District 3)

DISCUSSION
On April 19, 1994, the City Council authorized the execution of Lease No. 23508 (Lease) with Stan Miller Yachts, Inc. (Stan Miller), a California corporation, for the use of portions of the Alamitos Bay Marina Center in the Alamitos Bay Marina (ABM), including showroom space of approximately 2,250 square feet, an outdoor display area consisting of approximately 3,570 square feet, and various slips within Basin 2 of ABM. On July 1, 1994, the City Council authorized the assignment of rights and delegation of duties of this Lease to Bancap Marina Center, Inc. (Bancap), a California corporation.

In June 2015, the City authorized Bellingham Marine Industries, Inc., to demolish, dredge and rebuild Docks 10 through 14 in Basin 2 as part of the ABM rehabilitation project. As a result, various slips designated to Stan Miller, pursuant to the Lease, are no longer in existence. In addition, the approved California Coastal Commission slip mix made it necessary to relocate the Stan Miller vessels. Therefore, staff is requesting authorization to amend the Lease to delete all references to the use of slips, since the slips no longer exist. All future slip rentals associated with Stan Miller will be handled through the ABM office and shall be separate from the rental of the facility. All other Lease provisions shall remain the same.

This matter was reviewed by Deputy City Attorney Linda T. Vu on February 9, 2016 and by Budget Management Officer Victoria Bell on February 10, 2016.
