TITLE
Recommendation to adopt resolution authorizing City Manager to execute a contract with Tri-Pacific Supply, Inc., of Rocklin, CA, for furnishing and delivering Philpott inline gas filters and associated parts, without advertising for bids, in an annual amount not to exceed $150,000, for a period of two years, with the option to renew for one additional one-year period, at the discretion of the City Manager. DISCUSSION
City Council approval is requested to enter into a contract with Tri-Pacific Supply, Inc. (Tri-Pacific), to furnish and deliver Philpott inline gas filters and associated parts to facilitate supplemental materials and supplies for Long Beach Gas and Oil’s (LBGO) Advanced Metering Infrastructure (AMI) project. The AMI project was authorized by the City Council on June 10, 2014. The implementation of AMI includes the installation and/or retrofit of approximately 150,000 gas meters throughout the cities of Long Beach and Signal Hill. The requested contract is to purchase the required replacement filters associated with the meter exchanges.
Tri-Pacific is the sole contracted manufacturer of the Philpott product line and is the only distributor of its products in California. Therefore, City Council action is requested to adopt a Resolution for a sole source purchase.
City Charter Section 1801 requires that contracts for City purchases be awarded to the lowest responsible bidder after a competitive bid process, but allows for awards without a competitive bid process if accompanied by a Resolution adopted by the City Council.
This matter was reviewed by Deputy City Attorney Richard Anthony on December 17, 2015 and by Budget Management Officer Victoria Bell on December 18, 2015.
TIMING CONSIDERATIONS
City Council action is requested on January 5, 2016, to ensure the contract is in place expeditiously in order to prevent any delay in the AMI project implementation.
