Recommendation to authorize City Attorney to pay sum of $210,000 in full settlement of the lawsuit entitled Holms v. City of Long Beach, et al.
DISCUSSION
On July 4, 2011, Long Beach Police officers encountered plaintiff while they were conducting an arrest. A use-of-force occurred during the encounter with plaintiff, and plaintiff alleges that defendants are responsible for his injuries and other damages. Defendants deny liability.
Following a jury trial with mixed verdicts, the parties negotiated a complete resolution of all issues, including attorney’s fees. There is a tentative settlement of the entire action for $210,000.00, inclusive of attorney’s fees and costs. The Economic Development and Finance Committee approved the proposed settlement on September 15, 2015.
