TITLE
Recommendation to authorize City Manager, or designee, to execute all documents necessary to increase Contract No. 32995 with C.S. Legacy Construction, Inc., by $690,254, for a total not-to-exceed amount of $8,700,000, for additional work required in constructing the Chittick Field project;
 
Increase appropriations in the General Fund (GF) in the Citywide Activities Department (XC) by $590,580; and
 
Increase appropriations in the Capital Projects Fund (CP) in the Public Works Department (PW) by $590,580.  (District 6)  
 
DISCUSSION
The Chittick Field project is located in the central part of the City on a site known as the Hamilton Bowl/Chittick Field (Site).  The Site, which operates as the Hamilton Bowl Detention Basin, is currently owned and operated by the Los Angeles County Flood Control District (LACFCD). The Site consists of approximately 19 acres of land used as a flood control detention basin and as a National Pollution Discharge Elimination System (NPDES) compliance site for the City of Long Beach and the City of Signal Hill.
 
On March 19, 2013, the City Council adopted Plans and Specifications No. R-6952 and authorized the City Manager to execute a contract for construction of improvements to Chittick Field with C.S. Legacy Construction, Inc., in the amount of $6,178,299.  On August 13, 2013, City Council authorized the installation of Musco track and field lighting, which increased the contract with C.S. Legacy Construction, Inc., by $719,727 for a revised not-to-exceed contract total of $6,898,026.  On April 22, 2014, the City Council authorized a new pump house and pump station improvements increasing the contract amount to $8,009,746.
 
The park celebrated a grand opening in April 2014 and has been utilized ever since; however, flood control work has not been completed. On June 10, 2014, Amended and Restated Lease Agreement No. 78217 was entered into by the City and LACFCD.  The lease agreement requires the transfer of ownership and maintenance of the new low-flow pump station from the City to LACFCD.  Further, LACFCD requires additional plan check, submittal review, and construction and design changes.  An increase of contract authority is being requested to cover the cost of satisfying these additional requirements in order to complete the project.
 
This matter was reviewed by Deputy City Attorney Linda Vu and by Budget Management Officer Victoria Bell on March 23, 2015.
 
CEQA ANALYSIS
 
The additional work will not change the Addendum to the Environmental Impact Report (EIR) approved on August 16, 2012.
 
TIMING CONSIDERATIONS
City Council action on this matter is required on April 7, 2015, in order to complete the construction and commissioning of the new low-flow pump station.   
 
FISCAL IMPACT
The revised contract amount is a not-to-exceed total of $8,700,000. The total project cost is estimated at $10,736,246 and includes park construction, pump station construction, project management, inspections and permitting. Of the total project cost, $10,033,666 is currently appropriated in the project and is supported by multiple funding sources in the Public Works Department.
 
Currently, $112,000 is available in the Capital Projects Fund in the Public Works Department from FY 12 non-recurring Uplands Oil Funds previously appropriated for the Courthouse Tunnel. The $112,000 will be reallocated to address this project shortfall. An appropriation increase for the remaining balance of $590,580 is requested in the Capital Projects Fund (CP) in the Public Works Department (PW) and is offset by revenue from the General Fund. An appropriation increase of $590,580 is needed in the General Fund (GF) in the Citywide Activities Department (XC) to fund the operating transfer. The appropriation increase is offset by funds previously set aside in the General Fund for Citywide liabilities. These funds are no longer needed for their intended use and are available for use to cover the Chittick Field shortfall.
