TITLE
Recommendation to authorize Department of Development Services to process a refund totaling $35,381 to Archstone-Smith in accordance with Long Beach Municipal Code Section 21.21.701 for the properties located at 490 Pine Avenue, 508 Pine Avenue and 155 East 4th Street. (Districts 1,2)
DISCUSSION
On October 25, 2007, Archstone-Smith paid for vesting tentative tract maps application fees totaling $41,625 for the properties located at 490 Pine Avenue, 508 Pine Avenue and 155 East 4th Street. The applicant has withdrawn the applications. Of the fees paid, $35,381 is eligible for a refund as follows:
1. 490 Pine Avenue $10,040
2. 508 Pine Avenue $13,840
3. 155 East 4th Street $11.501
Total $35,381
The City of Long Beach Municipal Code, Section 3.48.040, requires that refunds exceeding $10,000 be approved by the City Attorney and City Council. Therefore, an approval to process a refund in the amount of $35,381 is requested on behalf of the applicant.
This matter was reviewed by Assistant City Attorney Michael Mais on July 18, 2008 and by Budget Management Officer Victoria Bell on July 17, 2008.
TIMING CONSIDERATIONS
City Council action on this item is requested on August 12, 2008, to expedite processing of the refund.
FISCAL IMPACT
The refund amount of $35,381 will be refunded from the Development Services Fund (SR 137) where the collected fees were deposited.
