TITLE
Recommendation to increase appropriations in the Capital Projects Fund (CP 201) by $462,651.50 in the Department of Public Works (PW) to accept and budget reimbursement from the Metropolitan Transportation Authority for City costs for installation from the Metro Blue Line Safety Fence. (Districts 1,6)

DISCUSSION
On February 19, 2008, the City Council awarded a contract, in an estimated amount of $397,310 plus a 15% contingency, for the construction of a fence along the Metro Blue Line on Long Beach Boulevard from 6th Street to Willow Street. At that time, reimbursement details had not yet been finalized with the Metropolitan Transportation Authority, and previously appropriated Proposition C funds were used to expedite the start of the project.

On March 31, 2008, the Metropolitan Transportation Authority issued Work Order No. F402-300022-CN-09-01 authorizing reimbursement of up to $462,651.50 to the City for costs incurred on the project. Since the reimbursement funds will replace Proposition C funds used to begin the project, and are not currently budgeted, an appropriation increase is requested.

This matter was reviewed by Deputy City Attorney Linda Trang on June 24, 2008 and by Budget Management Officer Victoria Bell on July 3, 2008.

TIMING CONSIDERATIONS
City Council action is requested on July 22, 2008 to appropriate the Metropolitan Transportation Authority funds.

FISCAL IMPACT
The reimbursement from the Metropolitan Transportation Authority will replace Proposition C funding used to begin the project. There will be no change to the amount of Proposition C funds appropriated to the Transportation Fund (SR 182) in PW. An appropriation increase is necessary in CP 201 in PW to budget the Metropolitan Transportation Authority's funding.
